Text
A district court having proper jurisdiction, the Court of Appeals or the Supreme Court, if it has proper jurisdiction, may stay the execution of a sentence of death when a postconviction petition for habeas corpus challenging a judgment of conviction or sentence has been filed only after appropriate notice has been given to the appropriate respondent in the case.
