Text

The court may, without issuing a citation, appoint a guardian for the proposed protected minor if the petitioner is a parent who has sole legal and physical custody of the proposed protected minor as evidenced by a valid court order or birth certificate and who is seeking the appointment of a guardian for the minor child of the parent. If the proposed protected minor is a minor who is 14 years of age or older:

1.The petition must be accompanied by the written consent of the minor to the appointment of the guardian; or
2.The minor must consent to the appointment of the guardian in open court.
