subject to prior hearing requirement. The following nonadjudicatory actions or proposed actions by the board are subject to prior hearing in accordance with the provisions of Section 27 [74-9-27 NMSA 1978] of the Solid Waste Act: A. approval or modification of the plan; B. designation of solid waste districts and changes in boundaries of solid waste districts; C. adoption of any fees to be charged under the provisions of Section 39 [74-9-39 NMSA 1978] of the Solid Waste Act; and D. adoption of substantive and procedural regulations.
