Text
Nothing in the Environmental Database Act shall require disclosure by a state agency of: A. information that is confidential by state or federal law; B. sensitive biological information that cannot be made publicly available for the protection of species; C. information required to remain confidential for safety or security reasons; D. archaeological or cultural survey information, unless the information is already publicly available or, if the information is of cultural significance to an Indian nation, tribe or pueblo, the disclosure is done with permission from the relevant Indian nation, tribe or pueblo; or E. information that is not already provided to a state agency pursuant to rule or law.
