A. To aid in the detection and prevention of title insurer insolvencies, the association's board of directors may, upon majority vote:
(1)make recommendations to the superintendent for the detection and prevention of insolvencies; and (2) respond to requests by the superintendent to discuss and make recommendations regarding the status of a member insurer whose financial condition may be hazardous to policyholders or the public. Recommendations pursuant to this paragraph shall not be available for public inspection. B. The superintendent shall report to the association's board of directors when he has reasonable cause to believe that a title insurer may be insolvent or in a financial condition hazardous to its policyholders or the public.
