Text

As used in the Health Insurance Portability Act: A. "affiliation period" means a period that must expire before health insurance coverage offered by a health maintenance organization becomes effective; B. "beneficiary" means that term as defined in Section 3(8) of the federal Employee Retirement Income Security Act of 1974; C. "bona fide association" means an association that:

(1)has been actively in existence for five or more years;
(2)has been formed and maintained in good faith for purposes other than obtaining insurance;
(3)does not condition membership in the association on any health status related factor relating to an individual, including an employee or a dependent of an employee;
(4)makes health insurance coverage offered through the association available to all members regar
