§ 56:8-39 — Definitions

As used in this act: a. "Director" means the Director of the Division of Consumer Affairs in the Department of Law and Public Safety. b. "Health club" means an establishment which devotes or will devote 40% or more of its square footage to providing services or facilities for the preservation, maintenance, encouragement or development of physical fitness or physical well-being. The term includes an establishment designated as "reducing salon," "health spa," "spa," "exercise gym," "health studio," "health club," or by other terms of similar import. c. "Health club services" means those services offered by a health club for the preservation, maintenance, encouragement or development of physical fitness or physical well-being. d. "Health club services contract" means an agreement under which the buyer of health club services purchases or becomes obligated to purchase health club services. e. "Operating day" means any calendar day on which patrons may inspect and use the health club's facilities and services during a period of at least eight hours, except holidays and Sundays.
