§ 5:12-112 — 1 Injunction prohibiting unlawful gambling.

14. In addition to any other authority provided under law, whenever it shall appear to the Division of Gaming Enforcement that a violation of section 112 of P.L.1977, c.110 (C.5:12-112) or unlawful gambling in violation of Article IV, Section VII, paragraph 2 of the New Jersey Constitution, other than a sweepstakes offered or conducted in violation of section 2 of P.L.2025, c.128 (C.52:17B-139.15), has occurred, is occurring, or will occur, the division may, in addition to any other proceeding authorized by law, seek and obtain in a summary proceeding in Superior Court an injunction prohibiting such violation or unlawful gambling. In any such proceeding, the court may assess a civil penalty in accordance with the provisions of section 15 of P.L.2025, c.128 (C.5:12-112.2); order restoration to any person in interest of any monies or property, real or personal, acquired by means of such violation or unlawful gambling in accordance with the provisions of section 20 of P.L.2025, c.128 (C.5:12-112.7); and enter such orders as may be necessary to prevent the recurrence of such violation or unlawful gambling in the future and to remedy any past violation or unlawful gambling. In any action brought pursuant to this section, the court shall not suspend or revoke any license issued by the division. L.2025, c.128, s.14.
