3.
a.Where the public-private intersection contains a State highway, the Commissioner of Transportation by regulation shall approve the erection of an official traffic control device.
b.Where the public-private intersection contains a highway under the jurisdiction of local authorities, the local authorities by ordinance or resolution shall approve the erection of an official traffic control device, subject to the approval of the commissioner.
c.The commissioner by appropriate order may withdraw an official traffic control device from a public-private intersection. L.1991,c.298,s.3.
