Text

The commissioner shall issue a nonconforming lot access permit for a property a. on his own motion or b. after finding that:

(1)the property otherwise would not be eligible for an access permit under the access code because of insufficient frontage or other reason;
(2)the lot on which the property is located was in existence prior to adoption of the access code; and (3) denial of an access permit would leave the property without reasonable access to the general system of streets and highways. Every nonconforming lot access permit shall specify limits on the maximum permissible vehicular use of any driveway constructed or operated under that permit. L. 1989, c. 32, s. 5.
