2. a. A small employer health benefits plan subject to P.L.1992, c.162 (C.17B:27A-17 et seq.) shall provide coverage under every plan delivered, issued, executed or renewed in this State, on or after the effective date of this act, that meets the essential health benefits requirements provided by this section. b. Pursuant to section 3 of P.L.2019, c.354 (C.17B:27A-60), the commissioner shall define essential health benefits to include at least the following general categories and the items and services covered within the categories:

(1)ambulatory patient services;
(2)emergency services;
(3)hospitalization;
(4)maternity and newborn care;
(5)mental health and substance use disorder services, including behavioral health treatment;
(6)prescription drugs;
(7)rehabilitative and habilitati
