Text

I. The covenant not to sue shall protect against liability for contamination addressed by an approved remedial action plan, including any modifications made pursuant to RSA 147-F:13, II. II. The covenant shall be in a form approved by the department of justice and shall contain a general description of the property and the contamination, a summary of the approved remedial action plan and a detailed description of any use restrictions placed on the property, including their scope and purpose, and the possibility of additional or modified use restrictions imposed by the department in accordance with RSA 147-F:15, IV. The covenant shall be expressly conditioned upon the provisions of paragraphs III and IV of this section. III.

(a)The covenant shall be voidable if the holder of the covenant:
