§ 64-03-12 — Duty of magistrate
The magistrate to whom any weighing or measuring device is delivered under section
64-03-10 shall request the commission to test it and, if found to be false, the commission shall
destroy it or deliver it to the state's attorney of the county in which the accused is prosecuted.
