Text
When a petition for the organization of a district is filed with the department of water
resources, the department shall fix a time for a hearing on the petition not less than fifteen nor
more than forty-five days after the filing of the petition. The department shall prepare a notice as
required by section 61-35-05. At least seven days before the date fixed for the hearing on the
petition, the notice must be published in the official county newspapers in the counties included
within the district. The applicant shall pay all costs of the publication notice.
