Should any landowner believe that the assessment of the damages suffered has not been
made fairly or equitably the landowner may appeal to the district court of the county in which the
land is situated, by filing a petition with the clerk of the district court of the county, asking for a
review of such assessment of damages. The appeal must be taken in accordance with the
procedure provided in section 28-34-01.
