Text
A power authorized under sections 59-16.1-04 and 59-16.1-05 may be exercised subject to
the provisions of section 59-16.1-10, unless expressly prohibited by the terms of the governing
instrument or by the provisions of section 59-16.1-10, but a general prohibition of the
amendment or revocation of the invaded trust or a provision that constituting a spendthrift
clause does not preclude the exercise of a power under sections 59-16.1-04 and 59-16.1-05.
