Text
1.An executive branch state agency, an institution of higher education, and any health
care provider or other person participating in the health information exchange may use
only an electronic health record system for use in the exchange which is certified
under rules adopted by the office of the national coordinator for health information
technology.
2.Subsection 1 does not apply if:
a.The office of the national coordinator for health information technology does not
require certification of the electronic health record system for that type of
provider; or
b.The North Dakota health information technology director waives the certification
requirement.
