The Medicaid fraud control unit is established as a division of the attorney general's office.
The Medicaid fraud control unit, which is under the supervision and control of the attorney
general, consists of the agents and employees the attorney general considers necessary and
appropriate. The Medicaid fraud control unit is a criminal justice agency within the meaning of
section 12-60-16.1. Agents designated by the attorney general have peace officer status and
authority, including the authority of search, seizure, and arrest. All recovered money will be
forwarded to the designated state Medicaid agency for appropriate allocation between the
