Subject to approval of the legislative assembly or the budget section if the legislative
assembly is not in session, the life skills and transition center may provide any service not
otherwise authorized by law under contract with a governmental or nongovernmental person.
The life skills and transition center shall determine the rates for services provided. The
legislative assembly or the budget section may approve the provision of a service under this
section only after determining the service is not otherwise being provided by either the private or
public sector. Any request considered by the budget section must comply with section
54-35-02.9.
