If a person with developmental disabilities or mental illness refuses an offer of services from
the project and, in the judgment of the project, the person's life, safety, or health is seriously
jeopardized, the project may petition a court of competent jurisdiction for the appointment of a
guardian or conservator. The project may also refer the matter to an appropriate agency,
department, or authority for possible civil action on behalf of the person with mental illness or
developmental disabilities, or for criminal prosecution of any individual abusing, neglecting, or
exploiting a person with mental illness or developmental disabilities.
