Text
1.Any record, report, or information obtained under this chapter must be available to the
public. However, upon a showing satisfactory to the department that disclosure to the
public of a part of the record, report, or information, other than emission data, to which
the department has access under this chapter, would divulge trade secrets, the
department shall consider that part of the record, report, or information confidential.
2.This section may not prevent disclosure of any report, or record of information to
federal, state, or local agencies when necessary for purposes of administration of any
federal, state, or local air pollution control laws, or when relevant in any proceeding
under this chapter.
