§ 7-7-2301 — Authority To Issue Refunding General Obligation Bonds

7-7-2301 . Authority to issue refunding general obligation bonds.

(1)The board of county commissioners of a county may issue, negotiate, and sell coupon bonds on the credit of the county, as provided in part 22 and this part, for the purpose of refunding, paying, and redeeming optional, redeemable, or maturing bonds when:
(a)there are not sufficient funds available to pay the bonds or there is a reduction in debt service as a result of issuing refunding bonds pursuant to 7-7-2304 ; and
(b)it is considered in the best interests of the county to refund the bonds.
(2)(a) The board has the authority to negotiate with the holders of the bonds of the county for an agreement or agreements whereby the bondholders agree to accept less than the full amount of the bonds and the accrued unpaid int
