Text
71-3-612 . Requirements to be bona fide purchaser. It must be conclusively presumed by the court that a party purchasing the property subject to the lien within the 30 days given in this part to claimants in which to file their liens is not an innocent third party nor that the party has become a bona fide owner of the property subject to the lien unless it appears that the party has paid full value for the property and has seen that the purchase money of the property has been applied to the payment of bona fide claims that are entitled to liens upon the same property under the provisions of this part, according to the priorities established in this part.
