§ 85-2-803 — Legislative Review

85-2-803 . Legislative review.

(1)A diversion of water from the basin pursuant to Article X of the compact consented to by the department under the provisions of this part may not be made until one of the following occurs, whichever is later:

(a)the legislature ratifies the first determination of the department to consent to a diversion of water from the basin pursuant to Article X of the compact; or

(b)July 1, 1983.

(2)A decision by the department to disapprove a diversion of water is not subject to legislative approval.
