82-2-425 . Shipper -- penalty for violation. A person or corporation who, as the shipper, violates 82-2-423 , as amended, is liable to the lessor and the lessee for 10% of the net returns from the shipment or sale of ores referred to in that section, in addition to the value of the interest of the lessor and the lessee in the shipment. This amount may be recovered in an action in any court of competent jurisdiction.
