47-1-301 . Appellate defender division -- personnel.

(1)There is an appellate defender division. The appellate defender division must be located in Helena, Montana. The head of the division is the appellate defender division administrator, who is hired and supervised by the director.
(2)The appellate defender division administrator must be an attorney licensed to practice law in the state.
(3)Subject to approval by the director, the appellate defender division administrator shall hire and supervise other personnel necessary to perform the function of the appellate defender division, including but not limited to:
(a)managing appellate public defenders;
(b)appellate public defenders; and
(c)other necessary administrative and professional support staff for the appellate defender divisio
