Text
If an execution is returned unsatisfied, the creditor may sue out of the court a scire facias against any one or more of the sureties of the executor or administrator, referring to the bond, the order of payment, the execution and return, and requiring the surety to show cause why judgment should not be rendered against him for the amount ordered to be paid and still unsatisfied.
