Text

1.The children's division shall establish reasonably accessible respite care facilities which may be utilized by foster parents licensed by the division.  Such licensed foster parents shall be permitted to leave agency foster children in the respite care facilities for periods of time determined jointly by the foster parent and the division and subject to available funds.
2.Such respite care facilities may be licensed day care centers or residential treatment centers who have contracted with the division to provide such services.  Licensed foster homes may also be designated as respite care facilities.
3.The children's division shall promulgate rules and regulations necessary to implement the provisions of this section.  No rule or portion of a rule promulgated under the authority
