There is hereby created in the state treasury the "Department of Health and Senior Services Disaster Fund", to which the general assembly may appropriate moneys and from which moneys may be appropriated annually to the department of health and senior services.  Moneys in the fund shall be expended during a state of emergency at the direction of the governor and upon issuance of an emergency declaration which shall set forth the emergency and shall state that it requires the expenditure of public funds to furnish immediate aid and relief.  The state treasurer shall be the custodian of the fund and the fund shall be administered by the department of health and senior services.  Notwithstanding the provisions of section 33.080 , moneys in the fund shall not lapse to the credit of general reve
