Text

1.  Any person who is appointed to act as a surrogate parent shall:

(1)Be at least eighteen years of age;
(2)Be free of any interest that may conflict with the interests of the child represented; and
(3)Not be an employee of the state board of education or any governmental entity having responsibility for the education or care of the child. 2.  No person shall be appointed to act as a surrogate parent of a handicapped or severely handicapped child unless he has completed the requisite education and training to be provided by the state board of education. 3.  The state board of education shall periodically evaluate the performance of persons appointed surrogate parents to ensure that such appointees are providing effective representation.  Such periodic evaluations shall take pla
