Subdivision 1.Employees.

(a)Except as provided in subdivision 3, assistant public defenders of the Second Judicial District are employees of Ramsey County in the unclassified service under section383A.286.

(b)Except as provided in subdivision 3, assistant public defenders of the Fourth Judicial District are employees of Hennepin County under section383B.63, subdivision 6. Subd. 2.Public employer.

(a)Except as provided in subdivision 3, and notwithstanding section179A.03, subdivision 15, clause (c), the Ramsey County Board is the public employer under the Public Employment Labor Relations Act for the district public defender and assistant public defenders of the Second Judicial District.

(b) Except as provided in subdivision 3, and notwithstanding section179A.03, subdivision 15, clause (c), the Hennepin County Board is the public employer under the Public Employment Labor Relations Act for the district public defender and assistant public defenders of the Fourth Judicial District.

Subd. 3.Exception.
Notwithstanding section611.265, district public defenders and employees in the Second and Fourth Judicial Districts who are hired on or after January 1, 1999, are state employees of the Board of Public Defense and are governed by the personnel rules adopted by the Board of Public Defense. Employees of the public defender's office in the Second and Fourth Judicial Districts who are hired before January 1, 1999, remain employees of Ramsey and Hennepin Counties, respectively, under subdivisions 1 and 2.
