Text
Subdivision 1.Remedy not exclusive.
Except as provided in this section, a criminal penalty, forfeiture, or fine imposed under section609.903,609.904,609.905, or609.911does not preclude the application of any other criminal penalty or civil remedy for the separate criminal acts. A prosecuting authority may not file a civil action under section609.911if any prosecuting authority has filed a previous criminal proceeding under section609.903against the same person based on the same criminal conduct and the charges were dismissed after jeopardy attached or the person acquitted.
Subd. 2.Restitution.
A restitution payment to a victim under section609.904does not limit the liability for damages in a civil action or proceeding for an amount greater than the restitution payment.
