Text

(a)Notwithstanding any law to the contrary, if a surviving spouse is receiving medical assistance under chapter 256B, when the person's spouse dies, then the provisions in paragraphs (b) to (f) apply.
(b)Any time before an order or decree is entered under section524.3-1001or524.3-1002or a closing statement is filed under section524.3-1003the surviving spouse may:
(1)exercise the right to take an elective share amount of the decedent's estate under section524.2-211, in which case the decedent's nonprobate transfers to others shall be included in the augmented estate for purposes of computing the elective share and supplemental elective share amounts;
(2)petition the court for an extension of time for exercising the right to an elective share amount under section524.2-211, in which case
