Subdivision 1.Court order. For any support order being enforced by the public authority, the public authority may seek a court order requiring the obligor to seek employment if:

(1)employment of the obligor cannot be verified;
(2)the obligor is in arrears in court-ordered child support or maintenance payments or both in an amount equal to or greater than three times the obligor's total monthly support and maintenance payments; and
(3)the obligor is not in compliance with a written payment plan. Upon proper notice being given to the obligor, the court may enter a seek employment order if it finds that the obligor has not provided proof of gainful employment and has not consented to an order for income withholding under section518A.53or entered into a written payment plan approved by the
