Text

Subdivision 1.Guardianship.

(a)When the court terminates parental rights of both parents or of the only known living legal parent, the court shall order the guardianship of the child to:
(1)the commissioner of children, youth, and families;
(2)a licensed child-placing agency; or
(3)an individual who is willing and capable of assuming the appropriate duties and responsibilities to the child.
(b)The court shall order guardianship of a child to the commissioner of children, youth, and families when the responsible county social services agency had legal responsibility for planning for the permanent placement of the child and the child was in foster care under the legal responsibility of the responsible county social services agency at the time the court orders guardianship to the commis
