Subdivision 1.Classification.
Except as provided in this section, data maintained by the office under sections256.974to256.9744are private data on individuals or nonpublic data as defined in section13.02, subdivision 9or 12, and must be maintained in accordance with the requirements of the Older Americans Act, as amended, United States Code, title 42, section 3058g(d).
Subd. 2.Release.
Data maintained by the office that does not relate to the identity of a complainant, a client receiving home-care services, or a resident of a long-term facility may be released at the discretion of the ombudsman responsible for maintaining the data.
