Text
Subdivision 1.Misdemeanor.
Unless a different penalty is prescribed, a violation of a provision of sections17.4981to17.4997or a rule of the commissioner governing the operation of an aquatic farm, private fish hatchery, or quarantine facility is a misdemeanor.
Subd. 2.Petty misdemeanor.
A first and second violation, within a three-year period, of sections17.4981to17.4997or a rule of the commissioner governing the operation of an aquatic farm, private fish hatchery, or quarantine facility is a petty misdemeanor if it does not involve intentionally falsifying records and does not put public waters or other fish hatchery facilities at risk from harmful nonindigenous species, nonindigenous strains, or emergency fish diseases.
