Subdivision 1.Misdemeanors. A person who violates a provision of this chapter is guilty of a misdemeanor. Subd. 2.Gross misdemeanors. A person is guilty of a gross misdemeanor who:

(1)willfully violates a provision of this chapter or order of the commissioner;
(2)engages in the business of drilling or making wells, sealing wells, installing pumps or pumping equipment, or constructing elevator borings without a license required by this chapter; or
(3)engages in the business of exploratory boring without an exploratory borer's license under this chapter. Subd. 3.Prosecution and venue. A violation of this chapter shall be prosecuted by the county attorney in the county where the violation occurred or is occurring. The trial shall be held in that county.
