Subdivision 1.Permit required.

(a)A person may not construct an elevator boring until a permit for the hole or excavation is issued by the commissioner.
(b)The elevator boring permit preempts local permits except local building permits, and counties and home rule charter or statutory cities may not require a permit for elevator borings. Subd. 2.License required. A person may not construct an elevator boring unless the person possesses a well contractor's license or an elevator boring contractor's license issued by the commissioner. Subd. 3.Sealing. A well contractor or elevator boring contractor must seal a hole or excavation that is no longer used for an elevator boring.
