Section 249E1/2. It shall be presumed in a prosecution under section two hundred and forty-eight or section two hundred and forty-nine E that the noncombustible residue, including ash, is excessive if a test, as determined by the current standard method of tests for sampling and analysis for coal and coke as published by the American Society for Testing Materials and designated as D 271, with the year of publication, produces non-combustible residue, including ash, in excess of the following percentages:
