A.

(1)Except as otherwise provided for in this Section, each health insurance issuer that offers health insurance coverage, as defined in R.S. 22:1061(2)(a), in the individual market of the state may not, with respect to an eligible individual, as defined in Subsection B of this Section, desiring to enroll in individual health insurance coverage:
(a)Decline to offer such coverage to, or deny enrollment of, such individual.
(b)Impose any preexisting condition exclusion, as defined in R.S. 22:1061(5)(p), with respect to such coverage.
(2)The requirement of Subparagraph (1)(a) of this Subsection shall not apply to health insurance coverage offered in the individual market where the state has adopted an alternative mechanism authorized by the Health Insurance Portability and Accountability
