§ 75-7426 — Same; third party liability under medicaid

Kansas·Ch. 75 STATE DEPARTMENTS; PUBLIC OFFICERS AND EMPLOYEES·Art. 74 KANSAS HEALTH POLICY AUTHORITY
(a)All third parties, including health insurers, self-insured plans, group health plans (as defined in section 607(1) of the employee retirement income security act of 1974), service benefit plans, managed care organizations, pharmacy benefit managers or other parties that are, by statute, contract or agreement, legally responsible for payment of a claim for a health care item or service to pay for care and services available under the plan, shall not, in enrolling an individual or in making any payments for benefits to the individual or on the individual's behalf, take into account that the individual is eligible for or is provided medical assistance under the Kansas state plan under title XIX of the social security act, commonly known as medicaid or medical assistance, administered by t
