The transfer authorized by this act shall be made by warranty deed if in the opinion of the attorney of the board of education such a deed is appropriate, and if in the opinion of the attorney a warranty deed is not appropriate, such transfer shall be made by quitclaim deed. The provisions of K.S.A. 72-3216, and amendments thereof, shall not apply to the transaction authorized by this act.
