Text
(a)"Designated family member", except as
provided in subsection (b), means the following:
(1)A franchisee's spouse, child, grandchild, parent, or sibling
who has been nominated as the franchisee's successor under a
written document filed by the franchisee with the franchisor.
(2)If no such document has been filed, the term means a
franchisee's spouse, child, grandchild, parent, or sibling who:
(A)if the franchisee is deceased, is entitled to inherit the
franchisee's ownership interest in the franchisee's business
under the franchisee's will or under the laws of intestate
succession; or
(B)if the franchisee is incapacitated, is appointed by the court
as the legal representative of the franchisee's property.
(3)If a franchisee is deceased, the term includes the appointed
