§ 33-42-10-3 — Security of stamping device

Text

(a)A notary public is responsible for the security of any stamping device used for notarial acts by the notary public.
(b)A notary public shall not allow any other person to make use of the stamping device used by the notary public.
(c)Upon the:
(1)expiration;
(2)resignation; or
(3)revocation; of the notary public's commission, the notary public shall damage, deface, destroy, erase, or secure the stamping device in a manner that precludes any further use of the stamping device.
(d)Upon the:
(1)adjudication of incompetency; or
(2)death; of a notary public, the notary public's guardian or personal representative shall preclude any further use of the stamping device by disabling the stamping device as described in subsection (c).
