§ 33-37-5-18 — Safe schools fee
(a)In each criminal action in which a person
is convicted of an offense in which the possession or use of a firearm
was an element of the offense, the court shall assess a safe schools fee
of at least two hundred dollars ($200) and not more than one thousand
dollars ($1,000).
(b)For each offense described in IC 9-21-8-52(b), the court may
assess a safe schools fee of at least two hundred dollars ($200) and not
more than one thousand dollars ($1,000).
(c)In determining the amount of the safe schools fee assessed
against a person under subsection (a), a court shall consider the
person's ability to pay the fee.
(d)The clerk shall collect the safe schools fee set by the court when
a person is convicted of an offense:
(1)in which the possession or use of a firearm was an element of
