Text
Whenever an emergency has passed or whenever medical care is no longer necessary under section 1(2) of this chapter, the child shall be returned to the child's parent, guardian, or custodian unless:
(1)a petition has been filed; and
(2)the court has determined under IC 31-34-5 or IC 31-37-5 that
the child should remain in detention.
