5.
(a)For purposes of an administrative
proceeding regarding an action taken by the department, the director or
the director's designee is the ultimate authority of the department.
(b)A designee of the director under subsection (a) must be:
(1)a deputy director of the department; or
(2)an individual who:
(A)is an attorney in good standing who is admitted to the
practice of law in Indiana; and
(B)is an employee of the department, except as otherwise
allowed under state and federal law.
