2.
(a)A licensed child placing agency may
not:
(1)require, as a condition for obtaining an adoption, that an
individual or a member of the individual's household receive an
immunization; or
(2)discriminate against an individual with respect to:
(A)the immunization status of; or
(B)a refusal to receive an immunization by;
the individual or a member of the individual's household.
(b)If a licensed child placing agency knowingly violates this
section, the department may:
(1)issue a warning to the child placing agency;
(2)place the child placing agency's license on probationary status;
or
(3)terminate the child placing agency license.
(c)Nothing in this section prohibits a licensed child placing agency
from making placement decisions based on the individual needs of a
medically fragil
