Text

(a)Subject to subsection (b), the plan sponsor of a health benefit plan may, on behalf of all covered individuals of the health benefit plan, provide consent:
(1)to the mailing to covered individuals by electronic means otherwise required by IC 27-1-43-3 of all communications related to the health benefit plan; and
(2)to the electronic delivery to a covered individual of any health insurance identification card.
(b)Before providing consent on behalf of a covered individual under subsection (a), the plan sponsor of a health benefit plan must confirm that the covered individual routinely uses electronic communications during the normal course of the covered individual's employment.
